10-5: SOLID WASTE SERVICE REQUIRED:
   A.   Account Maintenance: All persons must sign up and maintain an account with the city to receive sanitation service, when such service is provided by the city at the time the person purchases, owns, leases, uses or occupies, whichever occurs first, property within the city, regardless of whether the sanitation service is used. For purposes of this subsection, "maintain an account" means to open an account with the city for sanitation service and make all payments due on that account.
   B.   Termination Request: The owner of an unoccupied property may request termination of sanitation service by written request. If termination of sanitation service is requested, payment of all outstanding fees and charges shall be paid prior to termination. When the property owner desires to reestablish sanitation service, a new customer application will be required and all deposits, fees, and charges for establishing a new service shall be paid at that time.
   C.   Base Fees And Charges: Base fees and any charges for sanitation service shall apply even if a residence is unoccupied, unless service is terminated by the property owner as described in subsection B of this section.
   D.   Residential Sanitation Service Required: If water and sewer service is not provided to an individual property, residential sanitation service shall be required if available to be provided by the city to their residence. The failure of any person to accept sanitation service shall not exempt that person from the payment of the charges for the service and any fine or penalty for noncompliance.
   E.   Failure To Subscribe: Any person that is required to receive sanitation service from the city who fails to activate a sanitation account with the city as required in this section shall be subject to penalties, which include, but are not limited to, the total monthly fees they would have been assessed and an activation fee. This shall be in addition to any other penalties provided in this chapter.
   F.   Property Owner Responsibility: It is unlawful for any property owner to allow any person to lease, rent, or inhabit the owner's property if that person leasing, renting, occupying or inhabiting the owner's property does not maintain all utility services available and provided by the city.
   G.   Lessee/Renter Responsibility: It is unlawful for any person to lease, rent, or inhabit any property if that person does not maintain all utility services available and provided by the city.
   H.   Substitute Means Of Collection: In the event that the city manager, or the manager's designee, determines that the city is unable to reasonably, efficiently, or safely provide collection services to certain residents, establishments or communities such as, but not limited to, proximity of other serviced areas, size or density of development, or terrain, the city may substitute another means of collection or require the person to seek service from another source until the situation is resolved. At any time, the city may require any resident to receive city residential solid waste collection if the city manager, or the manager's designee, deems the service appropriate.
