5-4: RULES AND DEFINITIONS:
The following rules and definitions shall be used when interpreting the provisions of this chapter and the adopted codes. The definitions used in this section shall prevail over the definitions contained in the list of codes in Section 5-3.
 
ADMINISTRATIVE AUTHORITY:
When referenced in the Codes, shall mean the Building Official, Chief Building Official, Authority Having Jurisdiction, Community Development Director, City Manager, or City Council, as appropriate.
BOARD OF APPEALS:
When used in the Codes or this Chapter shall refer to a board commissioned by the City Council and Mayor whose sole duty is to hear appeals from the decisions of the Building Official, determine the suitability of alternative materials and construction methods, and to permit interpretations of the provisions of the Codes not related to administration. References to any other boards in the Codes shall not have jurisprudence unless specifically appointed and commissioned pursuant to this paragraph and are hereby superseded by this section.
BUILDING OFFICIAL;
Such other person charged with the enforcement of the Codes as established by Section 5-3 of this article or such other person as may be charged with the enforcement of the Codes by the City Council and Mayor from time to time. Wherever the terms Chief Building Official, Administrative Authority or Authority Having Jurisdiction, they shall also mean the Building Official.
CODES:
The codes listed and adopted in Section 5-3.
COMMERCIAL:
When used herein, refers to the use of a building, addition or structure for assembly, business, educational, religious, institutional, recreational, industrial or any other nonresidential, or nonagricultural purpose.
JURISDICTION:
The areas within the incorporated limits or boundaries of the City of Eloy, Arizona.
NONCOMMERCIAL:
When used herein refers to the use of a building, addition or structure for residential or agricultural purposes. (Ord. 20-900, 12-14-2020)
