§ 36.01  EMPLOYEE LEAVE AND VACATION POLICY.
   (A)   Paid vacation.
      (1)   A new full-time employee will not be eligible for paid vacation during the first year of employment. After one year of employment they will have earned five days of paid vacation, which must be taken during the second year. During the second year the full-time employee will earn ten days of vacation time, which will be taken during the third year of employment. The maximum days per year will be ten days.
      (2)   No full-time employee shall take pay instead of time off. Upon termination of employment, vacation time earned will be included in the employee’s final check. Vacation time will be prorated for the present year upon termination of employment.
      (3)   All vacation time must be taken during the time for which it is earned. Accumulation of vacation is not permissible. Vacation schedules must be approved by the Town Council. The periods of earnings and vacation time will start and end at the date of employment for each full-time employee.
   (B)   Paid sick leave.
      (1)   Paid sick leave is a protection for the employee against loss of pay due to severe and prolonged illness. A new full-time employee does not receive paid sick leave during the first year of employment. Upon completion of 12 months of continuous employment he or she will have accumulated ten days of eligible paid sick leave.
      (2)   Paid sick leave can accumulate up to 20 days. Paid sick leave cannot be taken at the expense of losing it.
      (3)   Sick leave will be paid only when the employee presents a signed, valid, written doctor’s statement of illness for each sick day claimed.
      (4)   The Town Council must be notified on the first day of sickness by an employee.
      (5)   Upon termination of employment, an employee will not be reimbursed for unused sick leave.
   (C)   Paid bereavement leave. All full-time employees will be entitled to four paid days for the funeral of a member of their immediate family. IMMEDIATE FAMILY is to be defined as spouse, children, mother or father.
   (D)   Comp-time leaves.
      (1)   Comp-time off (at a rate of one and one-half) is to be owed in lieu of cash overtime compensation. Comp-time leave must be requested by the employee and the Town Council will grant comp-time leave within a reasonable period of requesting time off.
      (2)   The number of hours that may be accumulated in an employee’s “comp-time bank” is not to exceed 240 hours.
      (3)   Employees have the right to receive cash compensation for unused comp-time when employment is terminated.
      (4)   An employee will be allowed to use comp-time to cover time lost due to casual sickness, with the approval of the Town Council.
   (E)   Paid holidays.
      (1)   The following days will be considered paid holidays: New Years Day; Presidents’ Day; Memorial Day; July Fourth; Labor Day; Veterans’ Day; Thanksgiving Day; Christmas Day; and Columbus Day.
      (2)   An employee can elect to substitute his or her birthday for Presidents’ Day or Veterans Day.
   (F)   Unpaid leave of absence. The Town Council can grant an unpaid leave of absence of up to six weeks to a full-time employee when unusual and extraordinary circumstances require a full-time employee to not be at work for a specific period of time.
