(A) Any individual(s), corporation, business, or other entity, including those doing work for others, who violates any of the provisions of this chapter shall be subject to a forfeiture of not less than a civil penalty of $2,500 for each violation, plus the cost of prosecution. Each day a violation exists shall constitute a separate and distinct violation of this chapter and as such forfeitures shall apply accordingly. The Town Council may refer violations to a town designated attorney who shall prosecute violations.
(B) If any mobile home or manufactured home is placed on any property in the town without the required permit, the Town Council can have it moved at the owner's and/or real estate owner's expense. The Town Council can seek injunctive relief against anyone found to be in violation of this chapter. The Town Council, Town Clerk-Treasurer, or code enforcement officer(s) may enter the premises of any proposed or existing place where any mobile home is located, in order to inspect for compliance with this chapter.
(C) Recovery of costs associated with fines for this chapter shall be turned into the courts for collection in small claims courts and not certified to the County Auditor for collection as delinquent taxes if not paid within 30 days.
