(A) The town shall investigate any alleged violation of this subchapter that comes to its attention and, upon determining that a violation has occurred, it shall issue a ten-day written notice to the owner of the real property upon which the violation occurs, to remove the vegetation.
(B) The notice shall be in writing and shall contain the following information:
(1) Description of the violation of this subchapter;
(2) Address of the real property on which the violation occurs;
(3) Order of abatement to abate the violation and remove the offending vegetation within ten days of receipt of the notice; and
(4) Failing to comply with the order of abatement will result in the town entering the real property for the purposes of abating the violation, and the cost thereof, together with administrative expenses, shall be billed to the owner, and if not paid within 30 days, certified to the County Auditor for collection as delinquent property taxes are collected.
(C) The notice shall be mailed by first class mail, posted on the property or served by an equivalent means as permitted under I.C. 1-1-7-1, to the owner of the real property where the violation occurs as shown on the most recent records of the County Auditor. In the event there are multiple owners, notice to at least one of the owners in accordance with the foregoing shall be sufficient.
