§ 114.03  APPLICATION FOR LICENSE; INSPECTION OF PREMISES.
   (A)   Within 30 days after the effective date of this chapter, the owner or operator of every existing rooming house shall apply for, as hereinafter provided, a rooming house permit issued by the Village Clerk-Treasurer in the name of the individual offering space for rent and for the specific dwelling within which the rooming house or sleeping room/rooms are contained.
   (B)   The Village Clerk-Treasurer shall furnish forms on which the person offering space for rent shall indicate:
      (1)   The address of the building in which the rented facilities are located;
      (2)   The name, address, and telephone number of the owner of the building;
      (3)   Habitable rooms;
      (4)   The number and location of the toilets;
      (5)   The location and number of available off-street parking spaces; and
      (6)   Fire exits and fire escapes (where required).
   (C)   The Village Clerk-Treasurer shall issue a no-charge temporary certificate stating that a license has been applied for and that the license shall be issued or denied within 30 days or less after the date of the inspection by the Building Inspector.
   (D)   A copy of the application shall be sent to the Building Inspector who shall make an inspection of the building to determine whether or not it is in compliance with the village zoning code, the Hamilton County Building Code, regulations of the Hamilton County Board of Health, state fire regulations and in safe and sanitary condition.  He or she shall thereupon either notify the applicant that the application has been approved and that the license can be obtained from the Village Clerk-Treasurer within 30 days or the use discontinued, or notify the applicant that his or her building is not in compliance with the law and in what respects, and order it to be brought into compliance within 30 days from the date of the original inspection and a license secured, or to cease operations.
   (E)   The Clerk-Treasurer shall issue this permit when the Building Inspector certifies in writing that in his or her opinion all applicable building codes are complied with.  However, no permit may be denied on the basis of lack of off-street parking, provided all other building code provisions are complied with.  This exception does not apply to construction begun on or after December 1, 1988.
