§ 94.03  RECREATION BOARD.
   (A)   (1)   In accord with the provisions of R.C. §§ 755.12 through 755.18, there is hereby established an Elmwood Place Recreation Board.  The Board shall consist of five persons, two of whom shall be appointed by the School Board.  The other members shall be appointed by the Mayor with the consent of Council.
      (2)   All members of the Board shall be residents of the village and shall serve for terms of five years, except that the members first appointed shall be appointed for such terms that the term of one member shall expire annually thereafter.  Members of the Board shall serve without pay.  Vacancies in the Board, occurring otherwise than by expiration of term, shall be for the unexpired term and shall be filled in the same manner as original appointments.
   (B)   In that the current Recreation Committee was formed in accordance with division (A) above and is already filling many of the functions of a Recreation Board, the current Recreation Committee shall assume the positions, duties and authorities established by this section.
   (C)   The Recreation Board shall elect their own chairperson, secretary, select all other necessary officers to serve for a period of one year and may employ such other persons as needed.  The Board may adopt rules for the conduct of all business within its jurisdiction.
   (D)   The Recreation Board has the authority to supervise, equip, and maintain all village recreation facilities.  The Board shall organize and direct all official village recreational activities and events.
   (E)   The Recreation Board shall not have authority for any other activities or events that are not recreational in nature unless so authorized by the Village Council.  Council shall likewise, if necessary, define what is or is not recreational in nature.
   (F)   The Recreation Board has the authority with the approval of Council to employ such persons as are needed to carry out their programs.  The amount of compensation for these employees shall be determined by Council.
   (G)   The Recreation Board shall, within the limitations stated in division (H) below, direct the spending of all funds budgeted to it by Council and such funds as the Board may raise or otherwise obtain.  The Village Clerk-Treasurer shall be permitted once yearly, or from time to time as he or she may see fit, to audit the financial records of the Board and report his or her findings to Council.
   (H)   The Board must obtain the approval of the Village Council for all expenditures that exceed 10% of their total yearly budget.
   (I)   The Board may, adopt with the approval of Council, rules for the preservation of good order within the domain of its jurisdiction.
   (J)   The Mayor shall resolve all questions concerning Recreation Board jurisdiction relative to other village departments until such time as the Village Council wishes to address the matter. The Mayor shall be responsible for the day-to-day supervision of all recreation program personnel. The Mayor may discipline or dismiss such persons with the approval of Council.
   (K)   The Village Council may by ordinance and majority vote dissolve the Recreation Board authorized by this section at such time and for any reason it deems appropriate.
