373.12 MOTORIZED/MOTOR VEHICLES USE PROHIBITED ON THE RAILROAD RIGHT-OF-WAY.
   (a)   No person shall operate a motor vehicle, motorized bicycle, snowmobile, motorcycle, motorized scooter, motorized three-wheeler or like vehicles on the property known as the old railroad right-of-way from the northwest end at Witty Road to the southeast end, 2125 feet southeast of the center line of Schultz-Portage Road.
   (b)   Whenever such moving device as described in subsection (a) hereof is operated by any minor in violation of said subsection, a member of the police division is hereby authorized to cite such violator for such offense. For the first offense a letter describing the offense committed shall be forwarded by the Chief of Police as designated to the parent or guardian of the minor.
      (1)   For the second offense a member of the police division is authorized to impound the vehicle or other moving device mentioned in subsection (a) hereof. The impounded vehicle shall be surrendered to the parent or guardian of such minor upon the payment of a five dollar ($5.00) fee after full explanation to the parents or guardians of the minor of the reason for such impoundment.
      (2)   For a third or subsequent offense a member of the police division is hereby authorized to impound the moving vehicle. The vehicle so impounded shall be surrendered to the parent or guardian of such minor upon the payment of a twenty-five dollar ($25.00) fee after full explanation to the parent or guardian of such minor for the reason of such impoundment.
   (c)   Whoever violates this section is guilty of a minor misdemeanor.
   (d)   It shall be no offense under subsection (a) for the operation of a device described in said subsection if the operator is employed by a governmental agency, federal, state or local, or an agent of said governmental agency and said device is being used for governmental purposes.
