(a) The Elmore Parking Violation Bureau shall have the Jurisdiction over any parking infraction that is in violation of any section of the Elmore parking ordinance. All parking infractions that are in violation of a Village ordinance and that occurs within the Village limits of Elmore shall be handled pursuant to and be governed by this chapter and Ohio R.C. Chapter 4521 when applicable.
(b) Personnel.
(1) The Fiscal Officer is hereby appointed Clerk for the Elmore Parking Violations Bureau. The Fiscal Officer shall have the authority to appoint Deputy Clerks for the Parking Ticket Violations Bureau as needed.
(2) The Mayor shall have the authority to appoint a hearing examiner who shall:
A. Hear challenges to parking tickets at hearings set by the Parking Violations Bureau. At such hearing the rules of evidence need not be strictly followed.
B. Be compensated for services on a per diem basis.
C. Hold his position at will and at the pleasure of the Mayor.
D. Be a former law enforcement officer as defined in R.C. 2935.01 or present attorney licensed to practice law within the State of Ohio.
(3) The Mayor shall assign such other duties to Village personnel as is necessary to properly operate the Parking Violations Bureau.
(4) All fines and penalties established for a parking infraction shall be collected by the Fiscal Officer and paid into the Village Treasury.
