351.16 TOWING PROCEDURES.
   (a)   The Chief of Police or his designated representative, within his territorial jurisdiction, may order to be towed and into storage any motor vehicle, other than an abandoned junk motor vehicle, as defined elsewhere in this code, which has been parked illegally in violation of Section 351.03(n) regarding a parking violation of more than twenty-four hours in such posted zone. The Chief of Police shall designate the place of storage of any motor vehicle ordered removed by him.
   (b)   The Mayor is authorized to contract with operators of towing services to be responsible for providing towing services within the Village at a reasonable rate for each towing service. Any person desiring to redeem a towed vehicle shall appear first at the Police Department to provide satisfactory identity and ownership or right to possession.
   (c)   If the owner or operator of a motor vehicle that has been ordered in storage pursuant to this subsection or of a vehicle that is being removed under authority of this section arrives after the motor vehicle has been prepared for removal but prior to its actual removal from the property, the owner or operator shall be given the opportunity to pay a fee of not more than one-half of the charge of the motor vehicle that is normally assessed by the person or company who has prepared the motor vehicle or vehicle for removal, in order to obtain release of the motor vehicle or vehicle. Upon payment of that fee the motor vehicle or vehicle shall be released to the owner or operator and upon its release the owner or operator shall immediately remove the motor vehicle or vehicle.
   (d)   The owner of a motor vehicle that is ordered towed and into storage pursuant to this section may reclaim such vehicle upon payment of any expenses incurred in its removal. The owner of the vehicle shall obtain a release form from the Police Department. In any event, the Village shall not be responsible for any towing charges to the designated towing service operator. Upon presentation of the release form and the payment of all towing and storage charges accruing, the storage facility or towing company shall release the vehicle to the owner.
