919.08 STORM WATER MANAGEMENT RULES AND REGULATIONS.
   A storm utility rate was authorized by Ordinance 011-94, June 28, 1994.
   There is hereby levied and imposed upon all premises which have been improved within the Village just and equitable charges for storm drainage service or subsequent service maintenance, operation, and extension; and to establish a Storm Drainage Fund for the foregoing purposes.
   Such charges shall be collected with the monthly water bill of water users, billed with sanitary sewer for those connected to sewer alone or billed alone as storm drainage charge for those users not connected to and/or not charged for City water and/or sanitary sewer.
   Such charges shall be paid monthly by those liable therefor and placed in a Storm Drainage Fund into which all of such charges so collected shall be deposited and kept as a fund to be used
only for the purposes stated herein.
   Fees are based on area rather than property values. In no year shall the operating fund of the drainage utility show a loss.
   Because of the number of variables with apartments and business arrangements, numerable
rules and policies are in effect to be fair and equitable to all.
   To cover the unknown factors to the village utility, the owner will bear the cost of the unknown area and can at his option divide the cost among the tenants, lessee, renters etc.
   An example would be a 10,000 sq ft impervious area subject to the storm utility rate. If 2500 sq ft of that building was rented to a tenant known by the utility, then one quarter of that utility rate billing would go to the tenant. If that tenant had another 2500 sq ft rented that was unknown to the utility, it would be the landlord or owner’s option to collect that portion.
   As stated in the ordinance the base rate for 3166 sq ft or less is four dollars ($4.00). Any area more than 3166 sq ft will be on a percentage basis.
   Areas with more than one (1) tenant will have the four dollars ($4.00) fee divided equally unless an unknown situation warrants a more equitable division. In all cases a four dollar ($4.00) fee will be charged for 3166 sq ft or less, whatever the breakdown of sq footage would be.
   A ten percent (10%) penalty will be assessed on all charges not paid by the due date.
