§ 33.16 POWERS AND DUTIES.
   (A)   The powers and duties of the Presiding Judge shall include:
      (1)   The powers and duties set forth and conferred upon him or her under the provisions of the state’s Constitution and statutes, this code, and the ordinances and resolutions of the city;
      (2)   The keeping of a docket in which shall be entered each action and the proceedings of the Court therein;
      (3)   The responsibility for fixing and receiving all bonds and bails and receiving all fines, civil sanctions, penalties, fees, and other monies as provided by law;
      (4)   Payment of all fees, civil sanctions, fines, penalties, and other monies collected by the Court to the Treasurer; and
      (5)   Not withstanding any other provisions of the city code, management and administration of the City Court as a separate and independent branch of government in accordance with fiscal policies established by the City Council in the adoption of the budget and city personnel policies and procedures consistent with applicable state and federal constitutional mandates, statutes, and rules of the Arizona Supreme Court.
   (B)   The authority of the Presiding Judge pursuant to state law to manage and expend monies collected or granted pursuant to statute is hereby expressly affirmed. Further, the authority of the Presiding Judge to manage the Court budget in his or her sole discretion is also hereby expressly affirmed.
