(A) Persons desiring a sidewalk furniture encroachment permit, Class 2, shall make application to the Department together with a signed indemnification agreement in the form prescribed by the city and proof of insurance in the amounts established by the City Risk Manager for the use. The application shall be accompanied by a non-refundable application processing fee in an amount established by Council resolution as necessary to recover the costs incurred by the city to review and process the applications.
(B) The Department shall review the application to ensure the indemnification and insurance requirements have been met and the proposed placement of the encroachment complies with the requirements set forth herein and for public safety considerations and approve, conditionally approve, or deny the permit.
