§ 151.050 GENERAL PROVISIONS.
   Upon review of the application, the Department shall determine whether a sidewalk furniture encroachment permit is suitable for the encroachment requested in the application. Examples of the type of encroachments which may be approved by this permit are as follows:
   (A)   Sidewalk furniture such as tables, umbrella, chairs, benches, planters, and flower pots, all of which must be moveable;
   (B)   Ornamentations such as clocks, statues, totem poles, barber shop poles, flags, and seasonal decorations, none of which may constitute outdoor merchandise display. In cases where the ornamentation is a symbol of the business activity, e.g., a barber pole for a barber shop, a clock for a watch shop, and the like, the ornamentation shall be considered as a sign element, subject to the total allowable sign face area as measured in a front elevation view, in accordance with the standards set forth herein;
   (C)   Awnings, canopies, porte-cocheres; and
   (D)   Bus shelters, bicycle racks, and lockers.
