§ 131.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AEROSOL PAINT CONTAINER. Any aerosol container which is adapted or made for the purpose of spraying paint.
   BROAD-TIP MARKER. Any marker or similar implement which has a writing surface which is one-half of an inch or greater and containing anything other than a solution which can be removed with water after the solution dries.
   GRAFFITI. A drawing or inscribing a message, slogan, sign, or symbol or mark of any type that is made on any public or private building, structure, or surface, and that is made without permission of the owner.
   GRAFFITI IMPLEMENT. GRAFFITI IMPLEMENT means:
      (1)   Aerosol spray paint containers;
      (2)   Broad-tipped indelible markers (one-half inch or larger) or etching solution;
      (3)   Slap tags (graffiti stickers/labels professionally designed);
      (4)   Shoe polish;
      (5)   White tempura paint (also known as white out or liquid paper);
      (6)   Pencils/pens (only if found in area that items were used in tagging);
      (7)   Bleeders (applicator dispenses a thin film of specially formulated liquid paint);
      (8)   Markers;
      (9)   Etching (is the process of using strong acid to cut into the unprotected parts of metal surface to create a design in intaglio in the metal.)
   PAINT STICK, GRAFFITI STICK, or BLEEDER. An implement containing paint, wax, epoxy, or other similar substance.
   RESPONSIBLE PARTY. An owner, occupant, lessor, lessee, manager, license, or other person having the right to control a property.
