§ 130.21 IMPROPER DISPOSAL OF FLAMING OR GLOWING SUBSTANCES AND CIGARETTES.
   (A)   It shall be unlawful for any person, through intentional, careless, or negligent action, to throw or place any lighted cigarette, cigar, ashes, or other flaming or glowing substance, or any substance or thing which may cause a fire, in any place where it may directly or indirectly start a fire, or who uses or operates a welding torch, tar pot, or any other device which may cause a fire, who does not clear the flammable material surrounding the operation or take such other reasonable precautions necessary to insure against the starting and spreading of fire.
   (B)   It shall be unlawful for any person to throw or discharge upon any highway, right-of-way, sidewalk, or upon any public or private property any lighted or unlighted cigarette, cigar, or match, any flaming or glowing substance, or any substance or thing which may cause a fire. This division does not restrict a private owner in the use of his or her own private property, unless the placing, depositing, throwing, or discharging of the item on the property creates a fire hazard as determined by the El Mirage Fire Chief or designee.
