§ 53.09 REQUIREMENT TO MONITOR, ANALYZE, AND REMEDIATE.
   (A)   The City Manager or his or her designee shall have the authority to require responsible parties of a facility who spill chemicals or other pollutants offsite into the MS4 to clean up or remediate the spills whether accidental or not. In the event that the responsible parties of a business refuse to clean up or remediate the polluted discharge offsite into the MS4, the city will attempt to clean up the spill and back-charge the discharger for the cleanup effort based on the costs of the entire clean up operation.
   (B)   Where a reasonable basis exists to conclude that a person engaged in any activity and/or owning or operating any property has violated this chapter, the City Manager or his or her designee may require by written notice that the person undertake, at their expense, such monitoring and analyses and furnish the resulting reports to the City of El Mirage as deemed necessary to determine compliance with this chapter.
   (C)   Where a person engaged in any activity and/or owning or operating any property has violated this chapter, the City Manager or his or her designee may require by written notice that the person remediate or restore, within a specified period of time, any property, conveyance, or equipment contaminated by or otherwise adversely affected by the activities giving rise to the violation.
