§ 53.06 INSPECTIONS.
   (A)   The City Manager or his or her designee is authorized to enter and inspect real property, structures, and buildings as necessary to assess compliance with this chapter or storm water NPDES or AZPDES permit. These inspections shall be conducted in accordance with applicable constitutional or statutory requirements.
   (B)   Inspections conducted pursuant to this chapter may be expanded to include items covered by other chapters of the El Mirage City Code that relate to the quality or management of storm water.
   (C)   The City Manager or his or her designee may collect and analyze samples of storm water and significant materials, install and require the installation of storm water sampling and measurement devices, and examine records concerning significant materials and storm water.
   (D)   The City Manager or his or her designee may require the business owner/operator to install and maintain structural BMPs to control storm water pollution as needed, including, but not limited to, storm water type interceptors, sealed concrete berms, permanent awnings/roofs, and the like. The City Manager or his or her designee will determine whether the device(s) are acceptable based on the specific circumstances found within the confines of the property. The device(s) may be changed at the discretion of the City Manager or his or her designee if the potential pollutants or processes are changed or altered at the facility.
