§ 53.04 PROHIBITED PRACTICES.
   (A)   It shall be unlawful for any person to use, store, treat, or dispose of storm water, pollutants, or significant materials in a manner that creates a public nuisance as defined in § 53.03.
   (B)   It shall be unlawful for any person to release to a publicly-owned right-of-way or public storm drain system any substance that is not composed entirely of storm water except:
      (1)   Releases pursuant to a NPDES or AZPDES permit;
      (2)   Releases resulting from firefighting activities;
      (3)   Releases associated with authorized street and municipal maintenance activities; and/or
      (4)   Releases of materials as provided in divisions (D) or (E) of this section.
   (C)   It shall be unlawful for any person to, without good cause, interfere with or prohibit any city employee from conducting any activities in furtherance of the requirements of this chapter, including conducting inspections and collecting samples.
   (D)   This section does not prohibit releases of storm water from storm water retention or detention basins if a permit or approval is first obtained from the City Manager or his or her designee. A person seeking such a permit or approval shall demonstrate that the release is not reasonably expected to cause or contribute to a public nuisance as defined in § 53.03. Restrictions and chemical analyses may be required before a discharge permit is issued by the City of El Mirage.
   (E)   This section does not prohibit releases, provided those releases are not a significant source of pollutants to navigable waters and are discharged in a manner that does not create a public nuisance as defined in § 53.03, from: fire hydrant flushing; potable water systems, including water line flushing; foundation or footing drains that are not contaminated by pollutants; naturally occurring seeps, springs, wetlands, or riparian areas; diverted stream flows and rising groundwater; non-agricultural irrigation water and lawn watering; individual residential and not-for-profit/charitable fundraising vehicle washing; residential evaporative coolers and air conditioner condensate; dust control watering; and city street sweeping activities.
