§ 93.069 REQUIREMENTS OF BOND FROM ALL UTILITY COMPANIES AND OTHER BEFORE COMMENCEMENT OF WORK INVOLVING EXCAVATION OR REMOVAL OR PAVEMENT OR SIDEWALKS WITHIN THE VILLAGE.
   (A)   In addition to above requirements concerning removal of existing pavement, replacing and patching: any utility company, person, or other entity, before work may be performed which involves the removal of existing pavement, excavation, or removal of sidewalks, shall deliver to the Village Clerk to be filed in the office of the Village Clerk, a bond, with sureties to be approved by the Village Board of Trustees in the sum of $5,000 or such amount required by resolution of the Village Board of Trustees for a particular project, which bond shall contain the condition that said utility company, person, or other entity shall defend, save, keep harmless, and indemnify the village from all liability, claims, damages, judgments, costs, and expenses of every nature and description caused by or growing out of the making of any excavation, hole, or trench in any street, highway, alley, or thoroughfare, including the pavement, sidewalk, and sidewalk space in the village; the opening or removal of any pavement or any sidewalk surface, the placing of any obstruction, barricade material, equipment or apparatus of any nature in the street, highway, alley or thoroughfare, including the sidewalk and sidewalk space, and the failure to properly protect any excavation, hole or trench in any street, highway, alley, or thoroughfare, including the sidewalk and sidewalk space; and, any and all negligence on the part of said utility company, individual or other entity in the use and occupancy of any street, highway, alley, or thoroughfare, including the sidewalk and sidewalk space, while such work is being conducted.
   (B)   Said bond shall also provide that said utility company, individual, or other entity shall fill all trenches and replace all pavement in an acceptable manner as required by Ord. 368 and the Municipal Code. This bond shall provide that a 30-day written notice shall be given to the Village Clerk in the event of expiration or of proposed cancellation of such bond.
   (C)   Violation of this shall constitute a misdemeanor punishable as provided by § 93.999.
