§ 93.068 REMOVAL OF EXISTING PAVEMENT; REPLACING; PATCHING.
   (A)   It is the intent of the governing body to provide specifications and procedures to be used by utility companies in work involving the removal of existing pavement and replacement of fill material and a pavement patch in the installation, removal, or repair of buried utility lines.
   (B)   Work may be performed by or on behalf of a utility company which involves the removal of existing pavement for the installation, removal, or repair of buried utility lines only when the provisions of said ordinance are met.
   (C)   A plan showing the location of the line and proposed work must be submitted to the Street Commissioner and Village Clerk for approval at least 48 hours prior to the commencement of any work. All existing pavement shall be cut square by means of a power driven rotary saw. Pavement removed shall be disposed of at a site to be determined by the Street Commissioner. Any pavement undermined as a result of construction shall also be removed at the utility company’s expense.
   (D)   Barricades and warning signs shall be provided by the utility company while work is being completed. No trench shall be left open for more than 24 hours and all patches will be installed within seven days from the beginning of work.
   (E)   Backfill of all utility trenches will be compacted to 95% the maximum density at optimum moisture content of plus of minus 3%, ASTM D-698. The pavement patch will be of the same type and equal or better quality as the existing pavement. The patch will extend one foot on each side of the trench and be two inches thicker than the existing pavement.
   (F)   Violation of this section will constitute a misdemeanor punishable as provided by § 93.999.
