For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
PEDDLER. A person who:
(1) Travels by foot or by vehicle or other conveyance from place to place, from house to house, or in, about, along, or upon any street or place in the town; and
(2) Sells, barters, or exchanges or offers to sell, barter, or exchange at retail, by sample or otherwise, any products, goods, wares, or merchandise of any kind or description.
PERSON. A natural person, firm, corporation, association, club, partnership, society, or other entity organization.
SOLICITOR. A person who:
(1) Travels by foot or by vehicle or other conveyance from place to place, from house to house, or in, about, along, or upon any street or place in the town; and
(2) Takes or attempts to take orders for the sale of products, goods, wares, or merchandise of any kind or description for future delivery or for services to be furnished or performed in the future, whether or not that person has, carries, or exposes for sale a sample of the subject of the sale or collects advance payment on the sale.
TRANSIENT MERCHANT.
(1) A person who:
(a) Engages in a temporary business or itinerant business of selling and delivering or offering to sell and deliver products, goods, wares, or merchandise of any kind or description; and
(b) In furtherance of that purpose hires, leases, uses, or occupies any building, structure, vehicle, room, shop, or other place in the town for the exhibition and sale of those products, goods, wares, or merchandise.
(2) The term
TRANSIENT MERCHANT includes a person who occupies or uses any portion of a public street, sidewalk, or park or other public property for the taking of photographs, pictures, or motion pictures with the intent or purpose of selling or offering to sell those photographs, pictures, or motion pictures.
VEHICLE. Every device in, upon, or by which any person or property is or may be transported or drawn upon a street or public highway regardless of whether or not that device is moved by human power or is self-propelled. Find in I.C. 9-13-2-196.
