§ 31.22  ADOPTION OF ORDINANCES AND RESOLUTIONS.
   (A)   (1)   A two-thirds vote of all elected members, after unanimous consent of the members present to consider the ordinance, is required to pass an ordinance on the same day or at the same meeting at which it is introduced. 
      (2)   This restriction does not apply to a zoning ordinance or amendment to a zoning ordinance that is adopted under I.C. 36-7.
   (B)   A majority vote is required to pass an ordinance or resolution, unless a greater vote is required by statute.
   (C)   An ordinance, resolution, or order is considered adopted when it is passed by the required vote of the elected members and is signed by the President of the Council.
   (D)   If required by statute, an adopted ordinance, resolution, or order must be promulgated or published before it takes effect.
   (E)   If an ordinance prescribes a penalty for a violation, it must be published in the manner prescribed by I.C. 5-3-1 before it takes effect, unless it declares an emergency requiring its immediate effectiveness and is posted in one public place in each district in the town.
   (F)   Within a reasonable time after an ordinance is adopted, the Clerk-Treasurer shall record it in a book kept for that purpose.  The record must include the signature of the President of the Council, the attestation of the Clerk-Treasurer, and the date of each recorded item.
