10-13-1: PUBLIC ADMINISTRATOR:
   (A)   Abolishment Of Public Office: The publicly elected office of Public Administrator is hereby abolished in the County of Elko.
   (B)   Appointment Of Public Administrator: The Elko County Commission shall appoint or contract a Public Administrator that meets the requirements set forth in subsection 1 of this subsection:
      1.   Requirements Of The Public Administrator:
         (a)   Be at least 21 years of age;
         (b)   Not have been convicted of any felony for which his or her civil rights have not been restored by a court of competent jurisdiction or been convicted of any crime of fraud, misrepresentation, misappropriation, conversion, forgery, embezzlement and/or other financial crime; and
         (c)   Not have been found liable in a civil action involving a finding of fraud, misrepresentation, material omission, misappropriation, theft or conversion.
   (C)   Security Bond:
      1.   Every person appointed or contracted as the Public Administrator must give an official bond in an amount set by the County Commission, but no less than ten thousand dollars ($10,000.00). The bond must be conditioned, secured, approved and recorded as the bonds of other county officers, and must be so conditioned as to hold the principal and sureties liable for any breach thereof made by the Public Administrator while acting, or illegally refusing to act, in his or her official capacity.
      2.   The Board of County Commissioners may, upon reasonable cause shown, require a new bond or additional bonds at any time, to be given upon ten (10) days' notice in writing. If the new or additional bond is not given, the Board may declare the position vacant or the contract void. (Ord. 08-2019, 11-6-2019)
