11-2-6: FUNDING FOR LEGAL AID:
   (A)   Purpose: In addition to any other fee required by law, a filing fee is imposed on certain civil actions in district court and certain actions in justices' courts to offset a portion of the costs of providing pro bono programs and of providing legal services without a charge to abused or neglected children and victims of domestic violence. The fees collected shall be remitted to the organization operating the program for legal services that receives the fees charged pursuant to Nevada Revised Statutes 19.031.
   (B)   Filing Fees On Civil Actions In District Court: In addition to any other fee required by law:
      1.   A fee of ten dollars ($10.00) on the commencement of any civil action or proceeding in district court for which a filing fee is required and on the filing of any answer or appearance in any such action or proceeding for which a filing fee is required.
      2.   A fee of twenty five dollars ($25.00) on the filing of any motion or other paper that seeks to modify or adjust the final order that was issued pursuant to chapter 125, 125B or 125C of Nevada Revised Statutes and on the filing of any answer or response to such a motion or other paper, except for the following:
         (a)   A motion filed solely to adjust the amount of support for a child set forth in a final order; or
         (b)   A motion for reconsideration or for a new trial that is filed within ten (10) days after final judgment or decree has been issued.
      3.   On or before the first Monday of each month, the Elko County clerk shall account for and pay over to the Elko County treasurer any such fees collected during the preceding month.
   (C)   Filing Fees On Actions In Justices' Courts: In addition to any other fee required by law:
      1.   A fee of ten dollars ($10.00) on the commencement of any action or proceeding in any Elko County justice court for which a filing fee is required and on the filing of any answer or appearance in any such action or proceeding, except on filings for small claims actions.
      2.   On or before the first Monday of each month, the justice of the peace of each Elko County township shall account for and pay over to the Elko County treasurer any such fees collected during the preceding month.
   (D)   Collection And Uses Of Fees: The Elko County treasurer shall pay all money received from the justices' and district courts on a quarterly basis to the organization authorized by subsection (A) of this section to receive the money. (Ord. 03-2006, 10-5-2006, eff. 11-27-2006)
