This Chapter is enacted pursuant to the terms and provisions of Chapters 308, 318, Nevada Revised Statutes, in order to create a Television District furnishing television signals and programming within that portion of Elko County hereinafter described:
From a point where the North latitude 40°15' intersects West longitude 116°9' North along said longitudinal line to a point where said longitudinal line intersects the Adobe Range, then in a Northeasterly direction along the Southeast slope of the Adobe Range to a point where said range intersects North latitude 41°10', then in an Easterly direction along said line of latitude to a point where said line of latitude intersections West longitude 115°5', then South along said line of longitude to a point where said line is intersected by the Northwestern slope of the Ruby Mountains, and then along said Northwest slope of the Ruby Mountains until the same intersects North latitude line 40°15', then West along said line of latitude to the point of beginning.
The District hereby created shall be known as the Elko Television District.
(A) The basic purpose for which the District is to be created is to acquire and maintain television facilities which will provide television signals to residents of the District.
(B) The District shall have and is authorized to utilize all the powers necessary to achieve the stated purpose as given by Chapters 308 and 318, Nevada Revised Statutes and, more specifically, but without limiting other powers, those powers enunciated in Section 318.1192 of Chapter 318, N.R.S.
(A) The Board of County Commissioners has found that there is an existing need for television facilities within the District and that the public convenience and necessity require its creation.
(B) The Board also finds that the creation of the District is economically sound and feasible.
(A) The Board of County Commissioners does hereby appoint five (5) taxpaying electors of the District to serve as the first Board of Trustees of the District, to serve at the pleasure of the Board of County Commissioners.
(B) Successors of the original members of the Board of Trustees shall be elected and appointed pursuant to the terms and provisions of N.R.S. Chapter 318, the same to ratified and included herein as though fully set forth.
(C) The members of the Board of Trustees shall qualify by filing with the County Clerk their oaths of office and corporate surety bonds, cost of the same to be borne by the District, in an amount of one thousand dollars ($1,000.00). The Board of County Commissioners may from time to time upon good causes shown increase or decrease the amount of such bond.
(D) The Board of Trustees shall meet regularly at least once a year at the office or principal place of the District, and at such other time or times at the same place as provided by District by-laws.
All terms and provisions of Chapter 318, Nevada Revised Statutes, material pertinent, relevant and applicable to the operation of the District are hereby ratified, confirmed and made a part hereof and nothing herein contained shall be construed to be in derogation of said terms and provisions, any and all such conflicts to be construed in harmony with statutory terms and provisions.
