(A) Noninterference: All pipes, sewers, drains, lines, valves or other structures and appurtenances laid or placed by any person shall be so located in the streets and highways in the County as not to obstruct or interfere with any pipes, sewers, drains, lines, valves or other structures already installed. Whether or not there is any such interference or obstruction shall be determined in the sole discretion of the County.
(B) Repair of Streets and Highways: If any portion of a sidewalk, curb, gutter, highway, street, alley, road or right of way shall be damaged by reason of defects in any of the pipes, sewers, drains, lines, valves or other structures and appurtenances installed, utilized, maintained or constructed, or by reason of any cause whatsoever, including the subsidence of any cut in the street or highway, or the existence of any pipes, sewers, drains, lines, valves or other structures and appurtenances constructed or maintained under this Section, the person who initially constructed such improvements shall, at his own cost and expense, within ten (10) days, repair any such damage and restore such sidewalk, curb, gutter, street, alley, public road or right of way, or portion thereof, to as good a condition as it existed before such excavation, disturbance, work, or other cause of damage occurred. (C) Bonding: To insure replacement of streets and highways in as good a condition as existed before the work, the person who is to do such construction shall enter into an undertaking with a surety company authorized to do business in the State of Nevada, and the County, to insure faithful performance of the conditions of this Section, in an amount and for a length of time, as determined by the County Engineer, necessary to insure compliance with the conditions of this Section.

The bonding requirement of this subsection may be waived by the Board of Elko County Commissioners in favor of a utility company with suitable guarantees/warranties of faithful performance contained in the franchise agreement; the suitability of the guarantees/warranties to justify an exemption from the bonding requirements of this subsection are to be determined in the sole discretion of the Board of Elko County Commissioners. (D) Construction Standards: All pipes, sewers, drains, lines, valves or other structures and appurtenances which shall be laid and used shall be installed, constructed and maintained in accordance with any applicable standards set by the Elko County Engineering Department, codes and ordinances of the County, Nevada Statutes and the rules, regulations and orders of the Nevada Public Service Commission, and in a good and workmanlike manner and shall be maintained in compliance with all applicable standards set by the Elko County Engineering Department, laws, ordinances, rules, regulations and codes from time to time in force.
(E) Relocation: Any person who lays or places any pipes, sewers, drains, lines, valves or other structures and appurtenances shall relocate, without expense to the County, any such pipes, sewers, drains, lines, valves or other structures and appurtenances when made necessary by any lawful change in any public street, road, or highway by the County.
