(A) Where an animal is found to be running at large in violation of Section 7-2-6, it may be captured and turned over to the Animal Control Officer or a deputy sheriff. If the animal is thereupon returned to its owner, the Animal Control Officer or Deputy Sheriff may issue a citation to the owner or file a report for criminal prosecution for violations of this Chapter. The citation shall indicate that the owner shall appear before the Justice of the Peace for disposition of the citation, or the date and time indicated on the citation.
(B) This Section shall not apply to service animal, or the animal used to aid persons with disabilities. Whenever such a service animal is found to be running at large and is captured, the Animal Control Officer or Deputy Sheriff shall take the service animal and return it to its owner.
