7-1-25: POSSESSION OF A DRUG WHICH MAY NOT BE INTRODUCED INTO INTERSTATE COMMERCE:
   (A)   Any person within Elko County who knowingly possesses, procures or obtains, processes, produces, derives, manufactures, sells, offers for sale, gives away or otherwise furnishes any drug which may not be lawfully introduced into interstate commerce under the Federal Food, Drug and Cosmetic Act, 21 United States Code section 301 et seq., is guilty of a misdemeanor.
   (B)   The provisions of subsection (A) of this section do not apply:
      1.   To physicians licensed to practice in Nevada who have been authorized by the Food and Drug Administration to possess experimental drugs for research purposes.
      2.   To any substance which has been licensed by the Nevada Commissioner of Food and Drugs, pursuant to Nevada Revised Statutes chapter 585, for manufacture in this State but has not been approved as a drug by the Federal Food and Drug Administration. The exemption granted in this subsection (B)2 does not grant authority to transport such a substance out of State. (Ord. 2001-A, 6-7-2001, eff. 7-1-2001)
