2-1B-1: TOWN ADVISORY BOARD CREATED:
   (A)   The Town Advisory Board shall have the powers and duties and require for membership the qualifications described in chapter 269 of the Nevada Revised Statutes.
      1.   The unincorporated Town of Montello shall include all of the portion of Section 17, Township 39 North, Range 69 East, MDB & M, which lies northwesterly of a line parallel with and two hundred feet (200') distant from, in a northwesterly direction measured at right angles, the original center line of the Southern Pacific Transportation Company's main line track between Sacramento, California and Ogden, Utah; which area includes, but is not limited to, the original townsite of Montello as described in the "Map of the Town of Montello" recorded in the office of the Elko County Recorder with file Number 107470, filed September 15, 1977.
      2.   The unincorporated Town of Montello shall also include the "certain buildings and property known as the Culver House and the Burton House situated in the Town of Montello, County of Elko, State of Nevada, which buildings are on a parcel of land one hundred sixty nine feet by one hundred feet (169' x 100') north of the southeast corner of the NE1/4 of Section 18, in T. 39 N. R. 69 E. MDB & M and running thence first, west a distance of one hundred sixty nine feet (169') to a point, then north a distance of one hundred feet (100') to a point; then at right, angles east a distance of one hundred sixty nine feet (169') to a point; thence right angles south a distance of one hundred feet (100') to the place of beginning.    (C)   The Town Advisory Board shall be composed of five (5) members who shall be selected by and serve at the pleasure of the Elko County Board of Commissioners. Each member of the Advisory Board shall be a resident and qualified elector in the Town of Montello. (Ord. 1982-K, 9-8-82, eff. 10-1-82; amd. Ord. 1984-H, 9-13-84, eff. 10-1-84)
   (D)   The terms of office of the Town Advisory Board members shall be two (2) years. The terms shall expire on the first Monday in January of each odd numbered year. If a vacancy occurs in the membership of the Town Advisory Board, due to removal by the Board of County Commissioners, resignation of a member, death of a member, or other cause, the Board of County Commissioners shall appoint a qualified resident of the Town to fill the vacancy and become a regular member of the Town Advisory Board for the unexpired term.    (E)   The Town Advisory Board of the unincorporated Town of Montello shall specifically have the power to manage the water distribution and sewage collection services; subject to the limitation that no expenditure shall exceed the amount budgeted for such expenditures in an annual budget previously approved by the Elko County Board of Commissioners.
   (F)   The members of the Town Advisory Board shall serve without compensation.
   (G)   The Advisory Board shall assist the Board of County Commissioners in governing the Town by acting as liaison between the residents of the Town and the Board and by keeping the Board advised as to all matters of interest to the Town and the residents thereof; but, the Advisory Board shall not expend or contract any Town funds for any purpose.    (H)   Should the population of the Town of Montello exceed one thousand (1,000) persons, then, in that event, members of the Town Advisory Board shall not be elected officials or elected members of any other governmental entity or body, or any public or quasi-public corporation organized under the laws of this State, including, without limitation, counties, cities, unincorporated towns, school districts, hospital districts, general improvement districts and other special districts.
