4-7-5: GW GROUNDWATER DISTRICTS:
   (A)   Intent: The GW Groundwater Districts are established to present recognition of a groundwater condition that provides notice to prospective developers and land owners that a specific condition may be expected in a given area. These Districts will include information regarding the absence of groundwater by existing drilling logs and published surveys; designated critical areas for groundwater use; and areas of known water sources that do not meet U.S. Public Health Standards for domestic use.
   (B)   Permitted Uses: All uses permitted in other districts designated in this Zoning Ordinance shall be permitted in the GW Districts, provided that the developer may first be required to obtain a use permit from the Planning Commission for the proposed use. The Elko County Building Inspector, Planning Advisor and County Manager may request such a use permit when in their judgment the proposed use and/or improvements are sufficient to constitute a threat to the health and welfare of the developer.
The use permit application may include sufficient evidence in the form of permits and/or recommendations from the State Engineer of the Water Resources Division and Health Department.
