(A) Each business engaged in the commercial production of electricity located in the unincorporated area of Elko County shall provide a reclamation bond. The reclamation bond amount is $10,000.00 per acre. “Acre” for the purposes of calculating the bond amount shall include the total area of the land leased or owned by the business used for the commercial production of electricity.
(B) The bond amount shall be adjusted every 10 years using the change in the IPD-GDP for the preceding 10-year period rounded to the nearest $100.00.
(C) Acceptable bond instruments include:
1. Cash.
2. Cashiers’ or certified check.
3. Surety bonds.
(D) The provisions of this section do not apply to any business established prior to the enactment of this Chapter. (Ord. 2023-10, 8-2-2023)
