§ 111.999 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   Any person authorized by the state to sell alcoholic liquors pursuant to the provisions of W.Va. Code Ch. 60, Art. 7, who shall do so within the corporate limits of the city without first having obtained a city license therefor shall, upon conviction of such violation of this chapter, be punished by a fine in an amount set by Council from time to time, or by imprisonment for a period not to exceed 30 days, or by both such fine and imprisonment. The Municipal Court of the city shall have jurisdiction to hear and determine all cases brought hereunder. For the purposes of this division (B), a LICENSEE shall be deemed to include any agent, employee or member of such licensee who shall, on such licensee’s premises, sell alcoholic liquors, as provided by the W.Va. Code Ch. 60, Art. 7, without having obtained a city license as hereinbefore provided.

   (C)   Any person who violates any provision of § 111.050 including, but not limited to, any provision of § 111.050 or who commits any of the acts herein declared to be unlawful, shall be guilty of a misdemeanor, and shall be punished for each offense by a fine in an amount set by Council from time to time, or imprisoned in jail for not less than 30 days or more than six months, or by both fine and imprisonment in the discretion of the court.
   (D)   (1)   Upon conviction of a violation of § 111.051(A), such person shall be fined in an amount set by Council from time to time or shall be imprisoned in jail for a period not to exceed 72 hours, or both such fine and imprisonment, or, in lieu of such fine and imprisonment, may, for the first offense, be placed on probation for a period not exceeding one year.
      (2)   Upon conviction of a violation of § 111.051(B), such person shall be fined in an amount set by Council from time to time or shall be imprisoned in jail for a period not to exceed ten days, or both such fine and imprisonment.
