§ 111.084 SPECIAL EVENTS LICENSE.
   (A)   Special event liquor licenses through the state’s ABC administration are available to an organization, association or a non-profit corporation. Note: individuals are not eligible to obtain a ABC special events license; hence, individuals may not serve alcohol at the Darden House, and the Kump House or the Phil Gainer Community Center.
   (B)   This license allows the holder to sell or to provide alcoholic beverages to the public or event attendees.
   (C)   To obtain these licenses, the following must be completed:
      (1)   Step one. Complete reservation request. Obtain permission from the Council for the Darden House and the Kump House or the city’s Parks and Recreation Commission for the Phil Gainer Community Center to serve alcohol as required by the state’s ABC administration;
      (2)   Step two.
         (a)   Apply for and obtain a special events, fairs and festival nonintoxicating beer license through the state’s ABC Commission. Application can be found at:
         (b)   Note that all applications must be submitted 30 days prior to event.
      (3)   Step three. The applicant agrees to abide by city and state liquor laws. The applicant must obtain and provide proof of general liability insurance and liquor liability/dram shop insurance coverage as specified in this policy.
   (D)   Special provisions apply to any organization that charges to attend their event or wants to benefit from the sale of alcohol at their event:
      (1)   All alcohol must be purchased through a licensed distributor according to the regulations of the West Virginia ABC Commission;
      (2)   Donated alcohol/beer/wine cannot be used; and
      (3)   All permits must be on file with the city or the city’s Parks and Recreation Commission.
