In the absence of or in the case of the inability of the Municipal Court Judge to perform his or her duties, the Municipal Court Clerk may act as Municipal Court Judge if the Municipal Court Clerk has complied with the requirements set forth in W.Va. Code § 8-10-2(b) and (c), as are also required to be complied with by the Municipal Court Judge. The record of the compliance by the Municipal Court Clerk shall be kept as an official record of the Municipal Court.
