(A) Generally. The police officer’s Civil Service Commission existing immediately prior to the effective date of this code is hereby continued in full force and effect; and all the pertinent provisions of W.Va. Code §§ 8-14-6 through 8-14-23, inclusive, are hereby adopted by the Council and made applicable to the regular members of the Police Department, except the Chief of Police, and to applicants for such regular membership.
(B) Appointment from the list of eligibles. Every position, unless filled by promotion, reinstatement or reduction, shall be filled, in the manner specified in W.Va. Code § 8-14-15, from the Commission’s list of eligible, except that the eligible list may contain the names of less than three individuals. If the current list has been exhausted or if such list has been in existence in excess of a three-year period next preceding the date of the prospective appointment, the Commission shall proceed to establish an undated list of eligible in accordance with the code and with these rules and regulations and certify names from the new list of eligibles to the appointing officer.
(C) Political party. Pursuant to the authority granted to the city under the State Municipal Home Rule Pilot Program, under W.Va. Code § 8-l-5a, the city hereby declares itself to be exempt from the requirement that no more than two of the members of its Police Civil Service Commission be members of the same political party as required by W.Va. Code § 8-14-7.
