§ 33.077 BOARD.
   (A)   All property, powers and duties and the management and control of the Commission shall be vested in a Board of three members appointed by the Council for terms of five years. Members first appointed shall serve respectively for terms of one year, two years and three years. Thereafter, members shall be appointed for terms of five years each. Vacancies shall be filled by appointment for the unexpired term only. As the term of each initial appointee expires, the successor to fill the vacancy created by such expired term, shall be appointed for a term of five years. No more than two of the members of such Board shall be from the same political party, and no member of such Board shall hold any office, other than the office of notary public, or employment under the United States of America, the state, any county or political subdivision thereof, or of any political party. All members of such Board shall be residents of the city. No member of such Board shall receive any compensation for his or her services as such, but each member shall be reimbursed by the Commission for any reasonable and necessary expenses actually incurred in the discharge of his or her duties as a member of the Board.
   (B)   Pursuant to the authority granted to the city under the State Municipal Home Rule Pilot Program, under W.Va. Code § 8-l-5a, the city hereby declares itself to be exempt from the requirement that no more than two-thirds of the total number of its Building Commission be members of the same political party as required by W.Va. Code § 8-33-3.
