ORDINANCE 287

 

AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF ELKINS, WEST VIRGINIA AMENDING AND SUPPLEMENTING ORDINANCE 274 KNOW AT THE ADOPTING ORDINANCE FOR THE CODIFIED VERSION OF THE ELKINS CITY CODE AS OF AUGUST 2, 2020

 

   WHEREAS, the City of Elkins has recently updated and codified its ordinances for publication as the Code of Ordinances of the City of Elkins, West Virginia; and

   WHEREAS, following codification, the Common Council passed Ordinance 274 known as the Adopting Ordinance for the updated codification; and

   WHEREAS, at the time of the final passage of Ordinance 274 on August 20, 2020, the provisions of the City Code establishing the Sanitary Board, § 52.25 through § 52.30, had been advertently omitted by the publisher; and

   WHEREAS, the Common Council has been determined that Ordinance 274 shall be amended and supplemented to include the adoption of the omitted provisions of the City Code;

   NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE COMMON COUNCIL OF THE CITY OF ELKINS THAT ELKINS CITY CODE § 52.25 THROUGH 52.30 BE ADOPTED AND SHALL CONSTITUTE PROVISIONS OF THE CODE OF ORDINANCES OF THE CITY OF ELKINS, WEST VIRGINIA AS WAS PROVIDED FOR IN ORDINANCE 274, ADOPTING ORDINANCE.

   If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and Common Council determines that it would have adopted this Ordinance without the invalid provision.

   This Ordinance shall become effective upon the date of its final adoption.
