§ 51.50 SPECIAL COLLECTIONS – YARD WASTE.
   (A)   Yard waste collection shall be provided only to single-family and special residential units served by the town. Yard waste collection shall be limited to one-half truckload per resident per week.
   (B)   Residents must call Public Works Department to schedule a yard waste pick up. The town will make every effort to pick up the yard waste within 72 hours of notification from resident.
   (C)   If yard waste exceeds one-half truckload (more than four cubic yards), a notice will be given, either personally to the occupant or by placing a written notice on the door of the residence, informing the resident that it is an oversized load and must be disposed of by the resident. The resident may contact the Public Works Department to request the delivery of a truck to be loaded by the resident. A fee for truck delivery and collection will be assessed, based on the schedule of fees. The resident may dispose of an oversized load of yard waste themselves. Additional service may be approved by the Public Works Director for an additional fee as set by the Board of Commissioners. Residents must complete and sign a town truck policy statement.
   (D)   Yard waste shall be separated from curbside trash and shall be placed together to constitute a single, separate collection in order for the town to carry out its other collection program. Collection forces shall collect an amount of yard waste that is customarily and reasonably associated with the residential unit(s) served, so long as it is properly prepared or containerized and in compliance with these regulations.
   (E)   Yard waste, such as grass trimmings, twigs, hedge trimmings, plant trimmings, hay, straw, pine straw and pine cones, shall be collected at curbside, provided that it is placed in plastic bags for collection. Bags shall be in good condition and of a size and weight that, when full, do not weigh more than 50 pounds each, and are such that one individual can easily pick up each bag, one at a time, for disposal. Plastic bags shall not be secured at the top when placed at curbside for collection.
   (F)   Containers used for yard waste shall have all lids removed and shall not exceed 32 gallons in size. Each container shall be equipped with handles. The town-provided rollout cart or wheelbarrows should not be used.
   (G)   Limbs collected by collection forces shall be no larger than three inches in diameter and no longer than four feet in length. Tree shrubbery and limbs shall have all protruding branches trimmed. Limbs must be stacked in small, neat piles such that a reasonable person would expect one individual to easily pick up each pile, one at a time, for disposal. Each pile shall weigh no more than 50 pounds, and shall not exceed four feet in height nor four feet in length.
      (1)   Town collection forces or its authorized agent will not collect tree stumps or trunks.
      (2)   Loose leaves shall be bundled, packaged or boxed into one-person loads, and may be placed, pending collection by the town, at the front of the premises in the grass strip between the street and the sidewalk where those strips are available; otherwise, they may be placed just off that portion of the street right-of-way normally used by vehicles or pedestrians or used for surface drainage purposes. During the portion of the year when special leaf collection equipment is used, which shall be from November through December, leaves may be piled loosely adjacent to and behind the curb or in front of ditch (not in street, gutter or roadside ditch) for collection by special equipment. Loose piles of leaves will not be collected unless they are free of trash such as broken glass, rocks, twigs, cans or other debris that might damage collection equipment.
      (3)   The Public Works Department may decline to collect any yard waste that is not prepared or placed for collection in accordance with these regulations or that exceeds the maximum amount.
      (4)   The Public Works Department shall not collect any tree or tree limbs from unimproved property, or when the service has been performed for a fee or results from land clearing work by a commercial yard service.
