§ 51.34 ILLEGAL DUMPING.
   (A)   It shall be unlawful for any person to place, discard, throw, drop or deposit, or cause to be placed, discarded, thrown, dropped or deposited any solid waste on:
      (1)   Any public street, sidewalk or alley within the town or on any property owned or operated by the town or any other public property, except in properly designated receptacles;
      (2)   Any property not owned by a person without the written consent of the owner, occupant or lessee thereof; or
      (3)   In any stream or body of water.
   (B)   This section shall not prohibit the dumping or placing of fill on private or public property with the owner’s permission of clean sand, dirt, broken brick, blocks, concrete, broken pavement and natural land debris, uncontaminated by other materials, or other material deemed suitable by the Public Works Director that would not create a nuisance or health hazard. The town shall deem the consent of the Town Manager permission for its own property.
