§ 150.28 CONFLICT WITH OTHER PROVISIONS.
Notwithstanding any express provision of this subchapter, should the requirements set forth herein conflict with the provisions of the State Building Codes in effect at the time of the construction of the structure, or as are currently in effect in this state, the “less” restrictive provisions shall apply to the alleged violation; however, the current provisions of the State Building Codes shall control and serve as the standard for all repairs, additions and re-modeling work to the structure in question. Additionally, in the event any provision, standard or requirement of this subchapter is found to be in conflict with any provision of any other ordinance or code of the town, the provision which establishes the higher standard or more stringent requirement for the promotion and protection of the health and safety of the residents of the town’s jurisdiction shall prevail.
