§ 53.13 ONSITE VISITS AND RIGHT OF ENTRY.
   (A)   The Health Officer shall enforce this chapter. The Health Officer shall be permitted to enter upon any property at any reasonable and proper time for the purposes of onsite visits, observation, measurement, sampling and testing necessary to carry out and assure compliance with the provisions of this chapter. The Health Officer shall ensure that all proposed, constructed, installed, replaced and abandoned private water wells comply with the applicable provisions of this chapter.
   (B)   By making an application for a new private water well or for the abandonment of a private water well, an owner authorizes the Health Officer, at reasonable times, to enter upon the lot or parcel of land where the well will be installed or abandoned, in order to perform activities required for the enforcement of this chapter.
   (C)   Every permit issued under this chapter shall include as a condition the right of the Health Officer, at reasonable times, to enter upon the lot or parcel of land identified in the permit, in order to perform activities required for the enforcement of this chapter.
   (D)   The Health Officer may obtain access to privately owned land in order to perform activities required for the enforcement of this chapter as authorized by I.C. 16-20-1-23.
