§ 157.042 RESPONSIBILITY FOR WATER BODIES.
   If a tract being subdivided contains a natural or constructed water body:
   (A)   The body of water may be designated “common area” which is owned in common by all of the lot owners in the subdivision. Each lot must have equal and undivided ownership and be so noted on the plat and in the subdivision restrictions; or
   (B)   Lot lines shall be drawn so as to distribute the entire ownership of the water body among adjacent lots. Responsibility for safe maintenance of the water body, including vector control, and the adjacent slope above the waterline shall be placed with the individual property owner(s).
