An interested person who objects to or is dissatisfied with the actions of the SWCD in approving or denying any application for a storm water clearance may file an appeal with the Board; provided the filing is made within 15 calendar days of the action of the SWCD in question. The action of the SWCD shall be final and conclusive after the appeal deadline has expired. Any appeal shall be accompanied by a filing fee in the amount of $50 payable to the Board and shall be filed on the forms required by the Board with the storm water clearance file being forwarded by the SWCD to the Board. The Board shall conduct a public hearing on the appeal within 45 calendar days after receipt of the filing. After an appeal has been filed, no land disturbing activities may begin or continue unless in compliance with the storm water clearance if one was issued. Following the conclusion of the public hearing which may adjourn from time to time, the Board shall render a decision on the appeal which decisions may affirm, modify or overturn the action of the SWCD or refer the matter back to the SWCD for further consideration.
