(A) It is acknowledged, understood and declared by the Board of Commissioners of the county, that under this chapter the Health Officer is required to exercise and is vested with the authority to exercise his or her discretion and judgment in order to protect and preserve the public health, safety and general welfare of the citizens of the county in regulating swimming pools.
(B) The authority of the Health Officer to issue, deny, suspend or revoke or fail or refuse to issue, deny, suspend or revoke any license, approval, order, registration or similar authorization under this chapter is declared to be discretionary.
