(A) Except as specified in I.C. 14-16-1-20(a)(4) (regarding authorization by law enforcement officers in emergencies) and I.C. 14-16-1-20(a)(5) (regarding special events), as now in effect and as from time to time hereafter amended, an off-road vehicle or snowmobile may not be operated in the public county rights-of-way or county-owned real property for the following highways, whether or not on the traveled part of said highways:
(1) County Road 17 from County Road 14 to County Road 40; and
(2) Any other limited access county highways as constructed or designated from time to time hereafter.
(B) The Commissioners have determined that there is not sufficient width to operate a vehicle at a reasonable distance off and away from the traveled part of certain additional highways and streets listed in this division (B) in a manner so as not to endanger life or property. Accordingly, except as specified in I.C. 14-16-1-20(a)(2) (regarding the crossing of highways), I.C. 14-16-1-20(a)(4) (regarding authorization by law enforcement officers in emergencies), and I.C. 14-16-1-20(a)(5) (regarding special events), as now in effect and as from time to time hereafter amended, an off-road vehicle or snowmobile may not be operated in the public county rights-of-way or county-owned real property for the following highways and streets, whether or not on the traveled part of said highways and streets:
(1) County Road 17 from Michigan state line to County Road 14;
(2) Old US 33 from Ash Road to Elkhart city limits;
(3) Old US 20 (Toledo Road) from Ash Road to Elkhart city limits;
(4) Old US 20 (Toledo Road) from Pine Arbor Drive to Elkhart city limits;
(5) County Road 6 from Elkhart city limits to County Road 17;
(6) County Road 20 (Mishawaka Road) from U.S. 33 to Ash Road; and
(7) Those highways designated from time to time hereafter by the County Highway Department or County Commissioners.
