A violation of this subchapter will be determined by the appropriate judicial authority based upon the totality of the circumstances present, including, but not limited to whether the person or entity has received notices of suspected illegal activity pursuant to § 132.25(C), (D) or (E), as well as the observation of such illegal activity of tenants and visitors of same by other tenants, persons residing or working in the vicinity of the subject real estate, or representatives, agents or employees of the city.
