§ 117.03  APPROVAL OR DENIAL OF APPLICATION.
   (A)   After the investigation is completed, the Chief of Police, the Fire Chief and the Health Officer of the Elkhart County Board of Health shall, on the basis of facts found by them, recommend either approval or denial of the application.  If any one of the officers recommends denial of the application, the officer shall set forth the reasons for the recommendation.  No license shall be issued by the City Controller unless it has been approved by the Chief of Police, the Fire Chief and the Health Officer of the Elkhart County Board of Health.
   (B)   The applicant for the license shall have an opportunity to correct or cure the defects or problems causing a recommendation of denial of the application, but the applicant must complete any corrective or curative steps or procedures prior to opening or, if during operation a defect or problem be discovered which would have resulted in  denial of license had the defect or problem been known, the applicant must complete curative or corrective steps or procedures immediately.
   (C)   The officer or officers who recommended denial of the application shall study, examine and reevaluate the steps or procedures taken by the applicant to correct or cure the defects or problems set forth after the initial investigation.  If the officer (or officers) is fully satisfied that the steps or procedures will, in fact, correct or cure the defects or problems previously noted, he or she shall approve the application at the approximate place on the form provided therefore.
