§ 93.003 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AGGRIEVED PERSON. Any person who:
      (1)   Claims to have been injured by a discriminatory housing practice; or
      (2)   Believes that the person will be injured by a discriminatory housing practice that is about to occur.
   COMMISSION. The Human Relations Commission.
   COMPLAINANT. A person, including the Commission, who files a complaint pursuant to § 93.075.
   CONCILIATION. The attempted resolution of issues raised by a complaint or by the investigation of a complaint, through informal negotiations involving the aggrieved person, the respondent and the Commission.
   CONCILIATION AGREEMENT. A written agreement setting forth the resolution of the issues in conciliation.
   DISABILITY.
      (1)   With respect to a person:
         (a)   A physical or mental impairment which substantially limits 1 or more of the person’s major life activities;
         (b)   A record of having such an impairment; or
         (c)   Being regarded as having an impairment; or
         (d)   An impairment described or defined pursuant to the federal Americans with Disabilities Act of 1990; or
         (e)   Any other impairment defined under I.C. 22-9.5-10.
      (2)   The term DISABILITY does not include current illegal use of or addiction to a controlled substance as defined in 21 U.S.C. § 802, I.C. 22-9.5-2-10(b).
      (3)   The term does not include an individual solely because that individual is a transvestite.
   DISCRIMINATORY HOUSING PRACTICE. Any act prohibited by §§ 93.055 et seq.
   DWELLING.
      (1)   Any building, structure or part of a building or structure that is occupied as, or designed or intended for occupancy as, a residency by 1 or more families; or
      (2)   Any vacant land that is offered for sale or lease for the construction or location of a building, structure, or part of a building or structure described in division (1) above.
   FAMILY. Includes a single individual and includes families, regardless of the actual or perceived sexual orientation, gender identity, or marital status of its members. Familial status also includes 1 or more individuals who have not attained the age of 18 years being domiciled with a parent or another person having legal custody of such individual, or the written permission of such parent or other person.
   PERSON. One or more individuals, corporations, partnerships, associations, labor organizations, legal representatives, mutual companies, joint stock companies, trusts, unincorporated organizations, trustees, trustees in cases under Title 11, receivers and fiduciaries.
   RESPONDENT.
      (1)   A person accused of a violation of this chapter in a complaint of discriminatory housing practice; or
      (2)   Any person identified as an additional or a substitute respondent pursuant to § 93.078, or an agent of an additional or a substitute respondent.
   TO RENT. Includes to lease, to sublease, to let or to otherwise grant for a consideration the right to occupy premises not owned by the occupant.
