§ 52.45 EFFLUENT METERS.
   Industrial and commercial users may be required to use a utility approved effluent meter to determine the flow of wastewater entering the POTW.
   (A)   It is the responsibility of the user to allow the utility to access the meter.
   (B)   It is the responsibility of the user to maintain the meter in working order. If the meter is not maintained in proper working order (e.g. chronic failure), the user shall be required to install a new meter. Chronic failure shall be defined as failure at least 3 times in a 24-month period.
   (C)   Failure to repair or replace a meter within 30 days or as approved by the Director shall subject the user to penalties as outlined in the Enforcement Response Plan Penalty Matrix.
   (D)   Meters shall be installed at a location that allows access to the meter from floor level, without the use of a ladder or other similar device and that will not subject the device to excessive heat or freezing.
